The Supreme Court of Nigeria has scheduled a hearing for October 22 regarding a suit filed by Kogi State and 15 other states challenging the constitutionality of the Economic and Financial Crimes Commission (EFCC) Act.

The states are questioning the legal foundation of the EFCC and the Nigerian Financial Intelligence Unit (NFIU), arguing that the EFCC’s establishment did not adhere to the Nigerian Constitution’s requirements.

The case, originally initiated by Kogi State, was consolidated with similar claims from states including Ondo, Edo, Oyo, Ogun, and others. The plaintiffs argue that the EFCC’s legal foundation stems from a UN convention, which was improperly integrated into Nigerian law in 2004, without following constitutional procedures.

Kogi’s Attorney General and others seek declarations that the EFCC lacks authority over state funds and related matters.
