
Some vulnerable residents of the Federal Capital Territory (FCT), including scavengers, beggars, and petty traders, have filed a lawsuit against the Minister of the FCT, Nyesom Wike, seeking N500 million in damages for alleged violations of their fundamental rights.
The lawsuit, filed by human rights lawyer Abba Hikima on behalf of the affected individuals, is before Justice James Omotosho at the Federal High Court in Abuja. Other respondents in the suit include the Inspector-General of Police, the Director-General of the Department of State Services (DSS), the Nigeria Security and Civil Defence Corps (NSCDC), the Attorney-General of the Federation (AGF), and the Federal Government.
The suit claims that the arbitrary arrest, detention without charges, harassment, and extortion of homeless individuals, scavengers, and petty traders violate Sections 34, 35, 41, and 42 of the Nigerian Constitution.
The applicants are demanding: 1. N500 million in general and exemplary damages for the alleged violations.
2. A public apology to the affected individuals.
3. Immediate policy reforms to protect the rights of vulnerable residents in the FCT.
Hikima alleged that on November 12, 2024, security operatives acting on Wike’s directive arrested and detained individuals perceived to be homeless, including petty traders and hawkers, along Ahmadu Bello Way, Abuja. He claimed the individuals were verbally harassed, physically threatened, and detained without charge.
The lawyer also deposed that the actions were a result of government failure to provide security and a decent standard of living for vulnerable Nigerians.
During the court hearing, legal representatives for the DSS informed the court of their counter-affidavit, while the other respondents were absent. Justice Omotosho has adjourned the case to February 4, 2025, and directed the issuance of hearing notices to the absent parties.
The applicants insist their rights to free movement and protection from inhumane treatment must be upheld and seek justice for the alleged abuse of power.
