Justice Inyang Ekwo of the Federal High Court in Abuja, Nigeria has invalidated the Peoples Democratic Party (PDP) primary election that declared Asue Ighodalo as its governorship candidate.

The court’s decision, delivered on July 4, 2024, ruled that the primary election held on February 22, 2024, was unlawful due to the exclusion of 378 delegates who were supposed to participate in the voting process.

This exclusion was found to be in violation of both the Electoral Act 2022 and the PDP’s own guidelines.

The judgment came in response to a suit filed by Kelvin Mohammed on behalf of the aggrieved delegates, challenging the conduct of the primary election at the Samuel Ogbemudia Stadium in Benin. Justice Ekwo’s ruling has consequently voided the primary election results, casting uncertainty on the PDP’s governorship candidacy.
